Terms of Service

Welcome to MerchShot. These Terms apply when you access our website or use our product visual services. By using the service, you agree to these Terms. If you do not agree, stop using the relevant service.

1. Service and accounts

MerchShot provides AI Product Photography and a browser-based Camera Photo Converter. The converter processes selected files locally in your browser.

Provide accurate account information, keep your sign-in credentials secure, and promptly tell us if you suspect unauthorized account use. You are responsible for activity under your account. Do not share accounts or use automation to evade account, access, or usage limits.

2. Your content

You or your licensors retain ownership of the product images, logos, packaging, prompts, and other materials you submit (“User Content”). You give MerchShot a limited, non-exclusive permission to receive, store, process, and transmit User Content only as needed to provide, protect, and support the requested service. This permission ends when the content is deleted or no longer needed for those purposes, subject to necessary backups and legal obligations.

3. AI-generated content

AI-generated results may contain errors or differ from the source product, including its color, logo, label, text, shape, or other details. Review each result before use. You are responsible for checking that your final materials are accurate and comply with applicable law and the rules of ecommerce, advertising, and other platforms where you use them. MerchShot does not guarantee that a result is error-free, non-infringing, or accepted by any platform.

4. Credits and payment

New accounts start with zero credits. The Pricing page shows the current Starter, Pro, and Business prices, monthly allowances, and annual entitlements. We reserve credits when a generation starts and settle only successful images. Technical failures release the corresponding reservation. Dislike of an otherwise successfully delivered result does not itself qualify for a credit refund. The actual grant schedule for paid plans is stated at checkout when subscriptions become available.

Starter, Pro, and Business are displayed as planned paid offers, but live checkout is not available and no live paid subscriptions or recurring charges are active. Before paid subscriptions open, checkout will state the total charge, billing interval, taxes if applicable, renewal, cancellation process, and any plan-change terms. Cancellation will stop future renewals under the terms presented at purchase.

Refund requests are handled under the Refund Policy.

5. Acceptable use

Do not use the service to create or distribute illegal content, infringe another person’s intellectual property or other rights, deceive or impersonate others, promote illegal goods, attack or disrupt the service, bypass access or usage limits, or conduct abusive automated activity.

6. MerchShot intellectual property

MerchShot’s name, marks, website, and software are protected by applicable intellectual property laws. These Terms do not grant you ownership of them. Except as permitted by law or authorized in writing, do not copy or distribute MerchShot materials.

7. Suspension and termination

We may temporarily suspend or restrict access when reasonably needed to address a security issue, service abuse, or a serious breach of these Terms. Where practical, we will notify you and give you a chance to resolve the issue. Any action remains subject to rights that cannot be limited by law.

8. Service availability and changes

We may update or temporarily interrupt the service for maintenance, security, or product changes. We will update the website when a change materially affects how a currently available feature works.
